Terms & Conditions.

GENERAL TERMS

  1. By accepting this agreement, you agree to comply with the Club Rules & Regulations, which are prominently displayed below and relate to facility use and your conduct. We reserve the right to make reasonable changes to the Terms & Conditions at any time, provided we give you advance notice of the change.

  2. In the event of your breach of the Rules, we may terminate this agreement with immediate effect upon notifying you. Your membership shall be cancelled immediately, and your access shall be limited until your next payment would have been due.

  3. In case of membership cancellation, it is your responsibility to inform your bank to confirm cancellation of payment instructions.

  4. We reserve the right to assign the benefit of this agreement and our rights thereunder to a third party, subject to notifying you. However, such assignment shall not prejudice your rights under this agreement.

  5. Please be advised that if we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it shall not hinder us from enforcing the terms of this agreement strictly at a future date.

  6. We reserve the right to increase our Fees at any time, subject to providing you with prior notice.

  7. Lockers are provided in all clubs for the convenience of our members. Please ensure that you lock all belongings away securely at all times, as management shall not be responsible for any loss or theft of any items whilst on the premises.

  8. Please be advised that lockers are only intended for use during the time you are in the club and are not allowed for overnight use.

CLUB RULES & REGULATIONS

  1. Definitions. All references to “the Club” and "FUSE" refer to Fortem Capital Ltd, its proprietors, management, employees, subcontractors, agents, and representatives.

  2. Application of Rules. Members’ use of the Club is subject to these Rules.

  3. Assumption of Risk. Use of the Club involves physical exercise, sport, and recreational activities that can be dangerous and may cause injury. Members’ use of the Club is voluntary, and they assume all risks of injury, damage, or loss that may be sustained as a result of, connected with, or in any way associated with their use of the Club.

  4. Duty to Seek Medical Advice. Members must take all necessary medical and professional advice to ensure their safety, verify their fitness, and confirm their suitability for use of the Club prior to membership and throughout the course of their membership.

  5. Personal Property. The Club is not responsible for any loss or theft of personal property brought to or left in the Club.

  6. Limitation of Liability. The Club shall not be liable for, nor shall it accept responsibility for, any injury, loss, or damage, whether arising under the express or implied terms and conditions of membership, whether direct or indirect, and including consequential losses arising out of any of the activities of the Club or in any way whatsoever, which does not arise from any negligent act or omission of the Club.

  7. Indemnification. Members fully and irrevocably indemnify, hold harmless and defend the Club, to the extent permissible under applicable law, against any and all liabilities, claims, and causes of action resulting from injuries, damages, or loss sustained by members arising from their attendance at, and use of, the Club.

  8. Governing Law. These Rules shall be governed by and construed in accordance with the laws of the Republic of Ireland, and any disputes arising out of or in connection with these Rules shall be subject to the exclusive jurisdiction of the Irish courts.

  9. Members must check-in at reception for every visit to FUSE and must not share their membership check-in access with anyone else.

  10. Member’s access and Member usage is monitored by CCTV to ensure the safety and security of our Members.

  11. On joining, all members are offered a free club induction to instruct them in equipment use.

  12. Before using a FUSE club and its equipment for the first time, members must declare any relevant or physical restrictions/limitations that increase their risk of injury.

  13. All members are recommended to partake in a club equipment induction.

  14. If you are unsure as to how to use any piece of equipment you must seek advice from a qualified member of FUSE staff before using such equipment.

  15. For safety reasons, bags are not permitted on the gym floor, and suitable, comfortable exercise clothing and footwear must be worn.

  16. As a courtesy to other members, a small gym towel must be carried to wipe down equipment after use.

  17. Members are asked to only use the lockers for the duration of their training session.

  18. Members are solely responsible for their belongings while visiting FUSE.

  19. No drunkenness, bad language, or aggressive behavior toward staff or other members is permitted on the premises.

  20. You may not use the club while under the influence of alcohol, narcotics, tranquilizers, or any medication or other substance that may affect your ability to exercise safely.

  21. FUSE reserves the right to refuse access or terminate Memberships.

  22. All fitness club users must comply with any reasonable request from FUSE staff regarding Health and Safety matters and to ensure the smooth running of the club.

  23. Members can join from 16 years and agree to accept responsibility for their conduct.

  24. Only Personal trainers who hold a FUSE Personal Training agreement can personal train out of FUSE fitness clubs. No other Personal trainers may personal train any member / non-member on our FUSE premises.

  25. Smoking, including e-cigarettes, is strictly prohibited in all areas of the club, including at the entrance.

  26. Members must inform FUSE of any change of contact and email address or telephone numbers.

  27. Members must ensure that they put weights back in their original place when finished.

  28. Misuse of the weights, such as dropping them on the floor, may result in the termination of membership.

  29. Members are prohibited from taking photographs/videos on the premises or in the Changing Rooms that may identify another member, or posting such items or remarks on the internet.

  30. Changing Rooms may close at certain times for security and deep cleaning.

  31. Members must arrive promptly for Class start times.

  32. All Members must book into classes in advance.

  33. If a pre-booked Member is unable to attend their Class, we request, as a courtesy to their fellow Members, they cancel the Class in advance.

  34. By accessing the club and using the fitness equipment, members are deemed to have read and understood the terms and conditions of membership.

MONTHLY MEMBERSHIP TERMS & CONDITIONS - PRINCIPAL TERMS

  1. This agreement becomes effective upon your acceptance through the web or digital joining process. Your membership will begin immediately, unless you opt for a deferred Start Date. If you have enrolled for a pre-opening membership rate at a new club, your membership will commence on the day when the club opens.

  2. As a member, you will be entitled to exercise all the rights and privileges available for the selected membership type. This agreement is non-transferable and cannot be assigned to any other person at any point in time.

  3. In compliance with our policy, we offer a discount to full-time students who present a valid Student Leap Card, which is recognized as the national student travel card. To avail of this discount, the member must first obtain a standard membership and then present their Student Leap Card at our club premises for verification by our personnel. Upon successful validation, the applicable discounted monthly subscription rate will be applied through the subsequent January. At that point, the member must re-validate their Student Leap Card with our staff to continue receiving the discounted rate.

  4. You are required to carry your club access QR code with you at all times to gain entry into the club.

  5. If you hold a No Contract membership a 30-day cancellation notice period is necessary. For those with a Contract membership, you may cancel it by providing a 30-day cancellation notice before the end of your Commitment Term.

  6. To process your cancellation for any membership type, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap MY PRODUCTS, 2. Tap ACTIVE or AUTO-RENEWED, 3. Select CANCEL. This is the exclusive and approved process for canceling your membership, and we are unable to accept cancellation requests through any other means. No other communication (phone or verbal) is accepted.

  7. When you become a member, the Registration Fee and the first month's Membership Fees will be charged to your credit card or debit card. However, it's important to note that the first month's Membership Fees are charged on a pro rata basis up until the 1st day of the following month. This means that the amount charged for the first month's Membership Fees will be based on the number of days from your start date up until the 1st day of the following month. The second charge for your Membership Fees will then take place on the 1st day of the following month. Please be aware that these fees are non-refundable except during the cooling-off period, which is explained below.

  8. If you change your mind after joining, you can take avail of our 14-day cooling-off period, starting from the date your membership begins. To request a refund, please email hello@fusetraining.ie before midnight on day 14 and contact us via our contact form at https://www.fusetraining.ie/contact. If you haven't used the club during this period, you'll be eligible for a full refund of all fees paid. However, if you have utilised the club before cancelling, we reserve the right to charge our guest pass rate for each day of club usage during this period. Be aware that any refunds issued at management's discretion are subject to a 5.6% administration fee.

  9. Your second monthly Membership Fee will be charged on the first day of the month following your membership start date, except if you joined prior to the club's opening, in which case it will be charged monthly after the club has opened. Monthly payments will be debited from your bank account, and you can modify your bank details if necessary by contacting us via our contact form.

  10. In case of medical reasons, your Direct Debit Membership can be paused for up to 90 days during the lifetime of the Membership. However, it is necessary to produce a letter from a medical professional to confirm the inability to use the facilities. Depending on the date of submission, any pre-paid fees will be credited upon your restart of membership. No refunds will be issued in such instances.

  11. Please be advised that subsequent monthly Membership Fees are not refundable, and in the event of an unpaid payment, it will be backdated to the due date, which is linked to your membership start date. If a monthly Membership Fee is returned unpaid or any other payment method is not honoured, we will notify you by email for payment and your access will be suspended. You must make payment by credit card or debit card to reactivate your access and avoid the €30 Registration Fee. Failure to pay will result in the automatic cancellation of your account and you will be required to pay the Registration Fee again if you wish to re-join. Please note that all unpaid Fees may be subject to bank charges, which will be borne by you.

UPFRONT TERM MEMBERSHIP TERMS & CONDITIONS - PRINCIPAL TERMS

  1. This agreement shall become effective upon your indication of acceptance in the web/digital joining process.

  2. Your membership shall commence immediately upon registration, unless you opt for a deferred Start Date. However, in case of pre-opening membership at a new club, your membership will commence on the day the club opens.

  3. As a member, you shall be entitled to exercise all the rights and privileges pertaining to the selected membership type. It is important to note that this agreement is non-transferable and cannot be assigned to any other person at any point in time.

  4. You are required to carry your club access QR code with you at all times to gain entry into the club.

  5. Upon your membership registration, the full year's Membership Fees shall be collected from you. It is important to note that these fees are non-refundable under any circumstances, except during the cooling-off period, as detailed below.

  6. If you change your mind after joining, you can take avail of our 14-day cooling-off period, starting from the date your membership begins. To request a refund, please hello@fusetraining.ie before midnight on day 14 and contact us via our contact form at https://www.fusetraining.ie/contact. If you haven't used the club during this period, you'll be eligible for a full refund of all fees paid.   7. If you have an Upfront Term Membership, this will be auto-renewed following the initial commitment term onto a No Contract Full Access monthly direct debit membership, unless cancelled with 30-day cancellation notice.

  8. To process your cancellation for any membership type, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap MY PRODUCTS, 2. Tap ACTIVE or AUTO-RENEWED, 3. Select CANCEL. This is the exclusive and approved process for canceling your membership, and we are unable to accept cancellation requests through any other means. No other communication (phone or verbal) is accepted.

  9. In case of medical reasons, your Annual Membership can be paused for up to 90 days during the lifetime of the Membership. However, it is necessary to produce a letter from a medical professional to confirm the inability to use the facilities.

  10. In the event that you allow your Membership to lapse, you may be required to pay additional fees to re-join.

PRESALE MEMBERSHIP TERMS & CONDITIONS

  1. The pre-sale rate, which is available for purchase prior to the opening date of a new FUSE club, shall be valid for one year only from the opening date of the club (unless a specified term length is offered in the description), or until you transfer to a higher priced category during the first 12 months, provided you do not cancel your membership during this period.

  2. It is important to note that any "life-time price promise" of membership rates shall be subject to the life of the membership and not the buyer. In the event of cancellation of the membership by either party under permitted terms, such membership agreements shall be considered broken.

  3. Your membership will be charged on the date of purchase, guaranteeing you the pre-sale rate prior to opening, which shall activate on the official opening date of the new club.

  4. Please be advised that the Pre-Sale rate cannot be used in conjunction with any other promotional or discounted rate.

CONTINUITY/AUTO-RENEWAL

  1. We would like to clarify our membership renewal policy. Upon the completion of your contract commitment term, your membership will be automatically renewed on a monthly basis at the prevailing non-contract rates. Please note that this is a one calendar month rolling contract, and we require a notice of at least 30 days to cancel your membership.

  2. If you wish to cancel your membership, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap MY PRODUCTS, 2. Tap ACTIVE or AUTO-RENEWED, 3. Select CANCEL. This is the exclusive and approved process for canceling your membership, and we are unable to accept cancellation requests through any other means. No other communication (phone or verbal) is accepted. Please note that we require your request to be received more than 30 days before the end of your commitment term to avoid automatic renewal at the prevailing non-contract rates for another one calendar month.

  3. Additionally, we would like to inform you that upon the completion of an annual membership, your membership will be automatically converted to a one calendar month rolling agreement. Monthly debits will be charged at the prevailing non-contract rates at that time, unless you modify your membership options through our Help Desk at https://www.fusetraining.ie/contact.

TRANSFORMATION CLINIC

I, the participant hereinafter referred to as (“I, me, my”) enter into this agreement with Fortem Capital Ltd, which will be providing the 28-day challenge program through its employees (hereinafter referred to as “FTC”). I understand the 28-day challenge program (herein referred to as “28”) has a series of terms and conditions, which I agree (in addition to the FTC waiver) to as follows:

1. Initial Paid 28-day Challenge Trial Membership Period Definition

1.1 Defined as:

(i) Your first 4 consecutive calendar weeks at FTC.

(ii) Commencing from the first Monday after your first payment.

(iii) Ending 28 days later.

1.2 Monday being the Monday in which your challenge induction occurred.

1.3 The end date and time of Sunday at 12:00 hrs (on your forth week) is still applicable if you commenced your first session on Wednesday due to any reason(s), including Public Holidays.

2. Payments Processing - FTC Partners With global payment processor, Mollie B.V. To Provide Secure Payments Processing

2.1 The initial paid 28-day challenge trial membership period is €99, to be paid in full before commencement.

Note: If you registered for another offer and/or redeemed a voucher, this is noted on our system.

3. Continuity/Auto-Renewal

3.1 You may terminate your 24-week transformation program auto-direct debit at ANY TIME during your initial paid 28-day challenge trial membership period, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap MY PRODUCTS, 2. Tap ACTIVE or AUTO-RENEWED, 3. Select CANCEL. This is the exclusive and approved process for canceling your membership, and we are unable to accept cancellation requests through any other means. No other communication (phone or verbal) is accepted.

3.2 No other communication (phone or verbal) is accepted.

3.3 Following the initial paid 28-day challenge trial membership period the 24-week transformation program continues on an auto-direct debit of €99 every 28 days for an additional 24 weeks (6 payments of €99).

3.4 If no auto-debit cancelation is received via the FUSE App within your first 28 days, the auto-direct debit is contracted for 24 weeks at €99 every 28 days (6 payments of €99).

3.5 Thereafter, the 24-week transformation program contract may not be terminated by you until the remaining 24- week period has elapsed unless due to Moving Permanent Residence or Medical Termination Exemptions which only require a 28 day (672 hours) written notice period of cancellation by emailing hello@fusetraining.ie only, i.e., a payment of a 4- week value (€99) of the 28 day debited amount (€99) as a termination fee to terminate your membership if you can no longer utilise the FTC services and facilities.

3.6 Following the completion of week 20 of the participant’s 24-week transformation program, the participant’s membership shifts automatically to a 28-day rolling agreement and the debits are charged every 28 days at €99 per 28 days unless membership options are modified via the FUSE App only. Transformation Training renews automatically on a 28 day basis with the same 28 day rate. A 28 day (672 hour) notice period of any cancellation is always required by the participant (even if the participant is on week 21, week 22, week 23 or week 24 of the 24-week transformation program) and must be submitted via the FUSE App.

4. Fees & Payments

4.1 Membership Type 1: Initial Paid 28-day Challenge Trial Membership Period: €99

4.2 Membership Type 2: 24-Week Transformation Program: €99 every 28 days for a total of 24 additional weeks (6 payments of €99) following the initial paid 28-day challenge trial membership period.

4.3 Membership Type 3: 28-Day Rolling Agreement: €99 per 28 days following week 20 of the 24-week transformation program.

5. EFT Payment Authorisation

5.1 The participant hereby authorises FTC or its assigns to make periodic charges or withdrawals (“EFT Authorisation”) from the participant's account or credit/debit card every week in the amount of €99 if the participant does not cancel their auto-direct debit during the first 28 days by the FUSE App only.

5.2 The participant waives the right to receive prior notice for charges of withdrawals made with respect to any uncollected payments or portions of the balance due.

5.3 If any direct debit payment fails, the participant authorises FTC to either:

(a) Add the outstanding sum to the next direct debit; and/or (b) Make additional direct debits to recover the outstanding amount; and/or (c) Make periodic charges or withdrawals from the participant's account or any other credit/debit card on file.

5.4 In the event the participant defaults on a direct debit payment and fails to remedy the default after notification by FTC, the participant authorises FTC to notify any debt collection agency of the default.

5.5 In the event debt collection proceedings are commenced, as referred to in clause 5.4:

(a) The participant will be liable for FTC’s legal fees and related costs.

5.6 Payment will be debited in the name of “FTC Training” on Sundays for the subsequent week.

6. Refunds

6.1 FTC does not provide refunds for change of mind.

6.2 Once the participant has gone through an initial phone consultation and/or 28-day challenge induction and/or if at any time during the 28-day challenge, the participant cannot continue their participation in the 28-day challenge, the participant cancels their involvement or stops attending the 28-day challenge, FTC will not refund any of the participant’s challenge payments (past and/or scheduled/due) for the first 28 days of the program. All payments are processed as scheduled on the challenge participant’s initial phone consultation with a FTC staff member.

6.3. All challenge payments are non-refundable.

6.4 This is due to the program being a time- sensitive, high-demand program with an extremely limited number of participants and you have reserved one of the limited spots. FTC has reserved a FTC staff member’s paid time for your challenge induction and provided all the materials received (body scan, nutrition plan, accountability journal, ebook, etc.).

6.5 Any cancellation (including extenuating circumstances and/or medical) forfeits all payments (past and/or scheduled/due) for the first 28 days of the program to FTC.

6.6 There are no exceptions to our refund policy. There are no refunds or partial refunds for the inability to complete the initial paid 28-day challenge trial membership period for any reason.

7. Membership Freeze/Pause Requests

The participant understands that:

7.1 To submit a complimentary freeze from the allocation included in the participant’s membership agreement, the participant must email bootcamps@fusetraining.ie

7.2 Complimentary freezes are limited to 8 weeks per each 24-week period due to: (i) Extenuating circumstances; (ii) Medical leave; and/or (iii) Travel (work/leisure).

7.3 They must submit a freeze request form at least 3 business days before the freeze period requested. A backdated request cannot be made.

7.4 All membership payments are non-refundable. Even if the participant notifies a trainer, the participant is still required to fill out a freeze request form. No other communication (phone or verbal) is accepted.

7.5 Upon expiration of the freeze period that the participant selects, their account will automatically reactivate and regular weekly non-refundable membership payments will resume.

7.6 Any suspended payments are added onto the initial term of the participant’s agreement, extending the participant’s membership term by the length of the freeze.

7.7 If the participant decides to cancel their membership during the freeze period the participant understands that: (i) The standard 28 days (672 hours) written cancellation notice requirement, i.e., a payment of a 4- week value (€99) is still applicable; and/or (ii) Contract period stated in the participant’s membership agreement is still applicable; and (iii) Freezes during the notice period are invalid.

7.8 Freeze requests longer in duration than three consecutive calendar weeks (even if submitted over multiple freeze extension requests) require: (i) A payment of a one week value upfront for the week the participant is recommencing training to reserve the participant’s spot. There are no extra charges, as this payment of a one week value upfront is credited towards the week that the participant is recommencing training; and (ii) A medical certificate from your doctor detailing the medical necessity of your medical freeze being longer in duration than three consecutive calendar weeks; or (iii) Travel documentation/itinerary detailing the necessity of your travel freeze being longer in duration than three consecutive calendar weeks.

8. Cancellation/Termination (Applicable ONLY To Those Participating In The 24-Week Transformation Program After The Initial Paid 28-day Challenge Trial Period)

8.1 FTC requires a termination request to be made via the FUSE App only. No other communication (phone or verbal) is accepted.

8.2 You understand that even if you notify your trainer, you are still required to cancel via the FUSE App to serve as your termination notice. You acknowledge that in the instance of termination, a membership termination request form must be completed.

8.3. FTC reserves the right to recover any costs and losses under this agreement.

8.4 Medical Termination Exemption

You may cancel your FTC membership with a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 28-day value (€99) as a cancellation fee if you can no longer utilise the FTC services or facilities due to: (i) Permanent illness; and/or (ii) Permanent physical incapacity. You must provide a medical certificate advising the exact nature of the permanent illness or permanent physical incapacity outlining specifically how this prevents you from utilising the FTC services or facilities. If applicable, this payment of a 28-day value (€99) as a cancellation fee can be used as membership credit when you can recommence utilising the FTC services or facilities.  If the illness or physical incapacity is not permanent, your membership will not be cancelled and only suspended for the duration of your illness or physical incapacity. Your membership will be suspended only after FTC receives a medical certificate stating what specific dates you cannot utilise the FTC services or facilities because of the impermanent illness or impermanent incapacity.

8.5 Moving Permanent Residence Termination Exemption

You may cancel your FTC membership with a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4- week value (€99) as a cancellation fee if you can no longer utilise the FTC services or facilities due to: (i) Permanently moving residence and your new residence is more than 25 kilometres from the FTC Gym, provided that you resided within 25 kilometres of the FTC Gym at the time you commenced your agreement.  You must provide a legitimate verification of your permanent move of residence using an official document to prove change of address.  Official documents to prove your change of address include, but are not limited to, the following: (i) Lease agreement with your name, commencement date and end date of the lease term specified; or (ii) Utility bill with your name and date issued specified.  Note: all payments up to the date of moving and a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4- week value (€99) as a cancellation fee is required.

8.6 Terminating The 24-Week Transformation Program Early

You’re still required to pay the weeks outstanding on your 24-week contract period. For example, if you signed up for the 24-week transformation program and you cancel at week 12, you must pay out 12 weeks.  8.7 Terminating At Week 21, 22, 23 Or 24 Of The 24-Week Transformation Program

You’re required to give a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 28-day value (€99) as a cancellation fee.

9. Rescheduling/Missed Sessions

9.1 The participant understands that missed training
sessions are not:  (a) Redeemable;  (b)
Transferable; or  (c) Able to be accumulated and rolled over into subsequent weeks.

9.2 The participant understands that missed training sessions do not carry over into the next week or phase. The participant is responsible for attending all of their training sessions. Training sessions missed due to a Public Holiday are not eligible for a refund, discount or replacement sessions at a later date. The participant understands that some payment periods may have less workouts (due to Public Holidays/missed workouts) however the weekly fee will still be deducted. The participant acknowledges that they will not receive a refund for a missed session. The participant understands that they may not use missed sessions in lieu of membership payments. The participant understands that missed sessions may not be carried over instead of paying for a week. The participant understands that payments may not be stopped to "catch up" missed sessions.

10. Express Assumption of Risk

10.1 I am aware that there are significant risks involved in all aspects of athletic activities and physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, FTC, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s).

10.2 I understand that the training at FTC may involve weightlifting, gymnastics movements, strenuous bodyweight exercises and other high exertion activities, and that I am not obligated to perform nor participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time during my training session. I understand that should I feel light-headed, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform my trainer and/or FTC.

10.3 I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of FTC. I am aware that this agreement is ongoing and will apply to all future occasions I participate in athletic activities and training at FTC.

10.4 I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger others or me. I represent that I am not aware of any medical or physical condition that would prevent me from participating in the training or from using equipment or facilities, which pose a serious health risk to me.

11. Waiver

11.1 In consideration of my participation in the training provided by FTC, I, for myself, my heirs, executors, administrators or assigns, do hereby release, waive, discharge and covenant not to sue FTC and/or its members, managers, officers, directors, agents, employees, and affiliated entities (hereinafter referred to as “Releases”) from liability, from any and all claims, including any negligence of FTC resulting in death, personal injury, accident or illnesses and property loss arising from, but not limited to, participation in the training and use of facilities, premises or equipment wherever located and by whomever provided.

11.2 In further consideration for the right to use equipment provided by FTC or equipment at another location, I acknowledge and agree that FTC has not inspected the equipment at FTC or another location or the suitability of the area for the training. I expressly release, hold harmless, discharge and indemnify (including costs and solicitor fees including disbursements) FTC and Releases for any loss, injury or damage from any cause, including negligence arising out of any location, and/or arising out of the use of my equipment or equipment or facilities provided by FTC.

12. Indemnity

12.1 I recognise that there are risks involved in the types of activities offered by FTC. Therefore I accept financial responsibility for any injury that may be caused to me or to any other participant due to my negligence. Should the above- mentioned parties, or anyone acting on their behalf be required to incur solicitors fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs.

12.2 I further agree to indemnify and hold harmless FTC, their principals, agents, employees, trainers, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by FTC, at an FTC location or at another location in which an FTC activity is held. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to a FTC location, and/or any area selected for training by FTC.

13. Severability And Jurisdiction

13.1 I further expressly agree that the foregoing provisions in this agreement are intended to be as broad and inclusive as permitted by the laws of Dublin, Ireland and if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I further acknowledge and agree that this agreement shall be governed by and shall be construed in accordance with the laws of Dublin, Ireland.

14. Acknowledgment of Understanding

14.1 I have read the release of liability, waiver of claims and assumption of risk provisions in this agreement and I understand that I am giving up substantial rights, including my right to sue.  14.2 I acknowledge that I am signing the agreement freely and voluntarily and intend, by my signature, that this document be a complete and unconditional release of liability to the greatest extent allowed by law.  14.3 By signing these terms for 28 I am accepting these terms and conditions and I further certify that I have fully read and understand the terms of this agreement and will comply with the contents herein.  14.4 I understand that I am able to consult this membership agreement to reference membership policies at any time.
