Privacy policy.
How FUSE collects, uses and protects your personal data.
This policy explains how FUSE collects, uses and protects your personal data when you visit our clubs, use our website, app or chat assistant, book a free trial or become a member.
We handle your data in line with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
Who we are
FUSE Gym is a trading name of Fortem Capital Ltd, a company registered in Ireland (company number 592077). Our registered office is FUSE HQ, Quinsborough Road, Bray, Co. Wicklow, A98 F8F2.
Fortem Capital Ltd is the data controller for the personal data described in this policy. For any question about your data, or to use any of your rights, email hello@fusegym.ie.
What data we collect
Depending on how you deal with us, we may collect:
- Your name, address, date of birth, email address, phone number and other contact details.
- Membership details: your plan, home club, start date, check-ins, class bookings and payment history.
- Payment details, such as your card or bank account details. These are handled by our payment providers, and we do not store full card numbers.
- Health information you give us, such as injuries or medical conditions you declare before training, and medical letters for a membership pause (see "Health information" below).
- CCTV images when you visit our clubs.
- Messages, feedback and enquiries you send us by email, phone, social media, WhatsApp or our website chat assistant.
- Device and usage information when you use our website or app, such as your IP address, device type and the pages you visit, partly collected through cookies.
- Your marketing preferences.
How we use your data and why
We only use your data where the law allows it. The legal basis for each use is:
- To provide your membership (contract): setting up and managing your membership, taking payments, giving you access to our clubs, booking classes, and sending you service messages about your account.
- To run and improve FUSE (legitimate interests): answering your enquiries, keeping our clubs safe and secure, preventing fraud and misuse, enforcing our Terms, and improving our services. We balance these interests against your rights.
- Marketing (consent): sending you offers and news by email, text or WhatsApp, and using advertising cookies. You can withdraw consent at any time.
- To meet our legal duties (legal obligation): keeping accounts and tax records, and responding to lawful requests from authorities.
Service messages about billing, your account and changes to your membership are part of your contract, so you cannot opt out of these while you are a member.
Health information
Health information is a special category of data under GDPR. We only collect it with your explicit consent, for example when you declare an injury or medical condition before training or send us a medical letter to pause your membership.
We use it only to keep you safe when you train and to decide on medical pause requests. Only the staff who need it can see it. We delete medical letters once your pause request has been decided. You can withdraw your consent at any time, but we may then be unable to offer some services safely.
CCTV
We use CCTV in our clubs for the security and safety of our members, staff and premises. Footage is kept for up to 30 days and then deleted automatically, unless we need it to investigate an incident, an insurance claim or a legal matter, or An Garda Síochána asks for it.
To ask for a copy of footage of you, email hello@fusegym.ie with the club, date and approximate time of your visit.
How long we keep your data
- Member records: for as long as you are a member, and then for 6 years after your membership ends, to meet accounting and tax rules and to deal with any legal claims.
- Enquiries and free trial bookings (non-members): for up to 12 months after your last contact with us.
- Marketing: until you unsubscribe or withdraw your consent.
- CCTV: up to 30 days, unless needed to investigate an incident.
- Medical letters: deleted once your pause request has been decided.
After these periods, we delete your data or make it anonymous.
Our website chat assistant
Our website and messaging channels may use an automated (AI) chat assistant to answer your questions. What you type into the chat is processed by our chat provider to answer your query, and our staff may review chats to help you further and to improve our service. Please do not share health or payment details in the chat.
Cookies
Cookies are small files stored on your device when you visit our website. We use:
- Essential cookies: needed for the website to work. These do not need your consent.
- Analytics cookies: to understand how people use our website, so we can improve it.
- Advertising cookies: such as the Meta Pixel, to measure our adverts and show you relevant FUSE adverts on other sites and apps.
We only set analytics and advertising cookies if you agree to them through the cookie banner. You can change your choice at any time using the cookie settings link on our website, or by clearing cookies in your browser. www.allaboutcookies.org explains how.
Under-18s
You can become a member from the age of 16. If you are 16 or 17, a parent or guardian must sign on your behalf and give consent for us to use your data as described in this policy. Free trials are for people aged 18 and over only.
Your rights
You have the right to:
- Access the personal data we hold about you and get a copy.
- Rectification: have inaccurate or incomplete data corrected.
- Erasure: have your data deleted where we no longer need it or have no legal reason to keep it.
- Restriction: ask us to limit how we use your data.
- Portability: receive the data you gave us in a common format, or have it sent to another organisation.
- Objection: object to us using your data based on our legitimate interests, and to direct marketing at any time.
- Withdraw consent at any time, where we rely on consent. This does not affect anything we did before you withdrew it.
To use any of these rights, email hello@fusegym.ie. We will reply within one month. To stop marketing, you can also use the unsubscribe link in any email or reply STOP to any text.
If you are unhappy with how we handle your data, please contact us first so we can try to put it right. You also have the right to complain to the Data Protection Commission at www.dataprotection.ie.
How we keep your data secure
We use appropriate technical and organisational measures to protect your data, including access controls, secure systems provided by our membership software and payment providers, and staff training.
Changes to this policy
We may update this policy from time to time. The latest version will always be on this page, and we will tell members about any important changes.
