GENERAL TERMS
By accepting this agreement, you agree to comply with the Club Rules & Regulations, which are prominently displayed below and relate to facility use and your conduct. We reserve the right to make reasonable changes to the Terms & Conditions at any time, provided we give you advance notice of the change.
In the event of your breach of the Rules, we may terminate this agreement with immediate effect upon notifying you. Your membership shall be cancelled immediately, and your access shall be limited until your next payment would have been due.
In case of membership cancellation, it is your responsibility to inform your bank to confirm cancellation of payment instructions.
We reserve the right to assign the benefit of this agreement and our rights thereunder to a third party, subject to notifying you. However, such assignment shall not prejudice your rights under this agreement.
Please be advised that if we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it shall not hinder us from enforcing the terms of this agreement strictly at a future date.
We reserve the right to increase our Fees at any time, subject to providing you with prior notice.
Lockers are provided in all clubs for the convenience of our members. Please ensure that you lock all belongings away securely at all times, as management shall not be responsible for any loss or theft of any items whilst on the premises.
Please be advised that lockers are only intended for use during the time you are in the club and are not allowed for overnight use.
CLUB RULES & REGULATIONS
Definitions. All references to “the Club” and "FUSE" refer to Fortem Capital Ltd, its proprietors, management, employees, subcontractors, agents, and representatives.
Application of Rules. Members’ use of the Club is subject to these Rules.
Assumption of Risk. Use of the Club involves physical exercise, sport, and recreational activities that can be dangerous and may cause injury. Members’ use of the Club is voluntary, and they assume all risks of injury, damage, or loss that may be sustained as a result of, connected with, or in any way associated with their use of the Club.
Duty to Seek Medical Advice. Members must take all necessary medical and professional advice to ensure their safety, verify their fitness, and confirm their suitability for use of the Club prior to membership and throughout the course of their membership.
Personal Property. The Club is not responsible for any loss or theft of personal property brought to or left in the Club.
Limitation of Liability. The Club shall not be liable for, nor shall it accept responsibility for, any injury, loss, or damage, whether arising under the express or implied terms and conditions of membership, whether direct or indirect, and including consequential losses arising out of any of the activities of the Club or in any way whatsoever, which does not arise from any negligent act or omission of the Club.
Indemnification. Members fully and irrevocably indemnify, hold harmless and defend the Club, to the extent permissible under applicable law, against any and all liabilities, claims, and causes of action resulting from injuries, damages, or loss sustained by members arising from their attendance at, and use of, the Club.
Governing Law. These Rules shall be governed by and construed in accordance with the laws of the Republic of Ireland, and any disputes arising out of or in connection with these Rules shall be subject to the exclusive jurisdiction of the Irish courts.
Members must check-in at reception for every visit to FUSE and must not share their membership check-in access with anyone else.
Member’s access and Member usage is monitored by CCTV to ensure the safety and security of our Members.
On joining, all members are offered a free club induction to instruct them in equipment use.
Before using a FUSE club and its equipment for the first time, members must declare any relevant or physical restrictions/limitations that increase their risk of injury.
All members are recommended to partake in a club equipment induction.
If you are unsure as to how to use any piece of equipment you must seek advice from a qualified member of FUSE staff before using such equipment.
For safety reasons, bags are not permitted on the gym floor, and suitable, comfortable exercise clothing and footwear must be worn.
As a courtesy to other members, a small gym towel must be carried to wipe down equipment after use.
Members are asked to only use the lockers for the duration of their training session.
Members are solely responsible for their belongings while visiting FUSE.
No drunkenness, bad language, or aggressive behavior toward staff or other members is permitted on the premises.
You may not use the club while under the influence of alcohol, narcotics, tranquilizers, or any medication or other substance that may affect your ability to exercise safely.
FUSE reserves the right to refuse access or terminate Memberships.
All fitness club users must comply with any reasonable request from FUSE staff regarding Health and Safety matters and to ensure the smooth running of the club.
Members can join from 16 years and agree to accept responsibility for their conduct.
Only Personal trainers who hold a FUSE Personal Training agreement can personal train out of FUSE fitness clubs. No other Personal trainers may personal train any member / non-member on our FUSE premises.
Smoking, including e-cigarettes, is strictly prohibited in all areas of the club, including at the entrance.
Members must inform FUSE of any change of contact and email address or telephone numbers.
Members must ensure that they put weights back in their original place when finished.
Misuse of the weights, such as dropping them on the floor, may result in the termination of membership.
Members are prohibited from taking photographs/videos on the premises or in the Changing Rooms that may identify another member, or posting such items or remarks on the internet.
Changing Rooms may close at certain times for security and deep cleaning.
Members must arrive promptly for Class start times.
All Members must book into classes in advance.
If a pre-booked Member is unable to attend their Class, we request, as a courtesy to their fellow Members, they cancel the Class in advance.
By accessing the club and using the fitness equipment, members are deemed to have read and understood the terms and conditions of membership.
WEEKLY MEMBERSHIP TERMS & CONDITIONS
This agreement becomes effective upon your acceptance through the web or digital joining process. This is a 1-week Rolling Term membership, which automatically renews every week until a valid cancellation notice is received.
As a member, you will be entitled to exercise all the rights and privileges available for the selected membership type. This agreement is non-transferable and cannot be assigned to any other person at any point in time.
Membership Fees are processed via payment every Thursday. This payment covers the full subsequent 7 days of membership access. Invoices are generated and renewal is confirmed 4 calendar days prior to the payment date.
When you become a member, the Registration Fee and the first week's Membership Fees will be charged. The first week's fees are charged on a pro rata basis up until the next scheduled Thursday payment date.
Membership Fees are paid in advance for the coming week’s access. The obligation to pay the membership fee is not dependent on the frequency of club usage. Fees are non-refundable as they cover a reserved spot and facility access.
To cancel your membership, you must provide a minimum 7-day (1 week) notice. Notice is effective 7 days from the next upcoming invoice date. If notice is received less than 7 days before a Thursday payment, that final payment will be processed to cover the notice period, and access will remain valid until the end of that paid week.
To process your cancellation, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap ME, 2. Tap MEMBERSHIPS, 3. Tap ACTIVE/AUTO-RENEWED, 4. Select CANCEL. This is the exclusive and approved process for canceling your membership. No other communication (phone, email or verbal) is accepted.
By joining, the Member acknowledges and agrees to the advertised terms: "Cancel Anytime, 1 Week Rolling Term and Billed Every Thursday." Claims for cancellation based on non-use or misunderstanding of the billing date will not be accepted.
You are required to carry your club access QR code with you at all times to gain entry into the club. Access will be suspended in the event of an unpaid payment. To reactivate access and avoid a €30 Registration Fee, payment must be made promptly via credit or debit card.
BI-WEEKLY MEMBERSHIP TERMS & CONDITIONS
This agreement becomes effective upon your acceptance through the web or digital joining process. Your membership will begin immediately, unless you opt for a deferred Start Date. If you have enrolled for a pre-opening membership rate, your membership commences on the day the club opens.
As a member, you will be entitled to exercise all the rights and privileges available for the selected membership type. This agreement is non-transferable and cannot be assigned to any other person at any point in time.
You are required to carry your club access QR code with you at all times to gain entry into the club.
To cancel your membership, you must provide a minimum 14-day (2 week) notice. Notice is effective 14 days from the next upcoming invoice date. If notice is received less than 14 days before a Thursday payment, that final payment will be processed to cover the notice period, and access will remain valid until the end of that paid week.
To process your cancellation, kindly use the self-managed method via the FUSE App: 1. In the home screen, tap ME, 2. Tap MEMBERSHIPS, 3. Tap ACTIVE/AUTO-RENEWED, 4. Select CANCEL. This is the exclusive and approved process; no other communication (phone, email or verbal) is accepted.
Upon joining, the Registration Fee and the first two weeks' Membership Fees will be charged. The first two weeks' fees are charged on a pro rata basis up until the start of the next billing cycle. The subsequent charge will take place on the first Thursday of the following bi-weekly period.
Bi-weekly payments will be debited from your bank account. You can modify your bank details if necessary by contacting us via our contact form. Subsequent bi-weekly fees are non-refundable.
In case of medical reasons, your membership can be paused for up to 90 days during the lifetime of the membership, provided a letter from a medical professional is submitted. No refunds will be issued; any pre-paid fees will be credited upon your restart.
If a payment is returned unpaid, your access will be suspended. You must make payment by credit or debit card to reactivate access and avoid the €30 Registration Fee. Failure to pay will result in automatic account cancellation. Unpaid fees may be subject to bank charges borne by you.
MONTHLY MEMBERSHIP TERMS & CONDITIONS
This agreement becomes effective upon your acceptance through the web or digital joining process. Your membership will begin immediately, unless you opt for a deferred Start Date. If you have enrolled for a pre-opening membership rate at a new club, your membership will commence on the day when the club opens.
As a member, you will be entitled to exercise all the rights and privileges available for the selected membership type. This agreement is non-transferable and cannot be assigned to any other person at any point in time.
You are required to carry your club access QR code with you at all times to gain entry into the club.
If you hold a No Contract membership a 30-day cancellation notice period is necessary. For those with a Contract membership, you may cancel it by providing a 30-day cancellation notice before the end of your Commitment Term.
To process your cancellation for any membership type, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap MY PRODUCTS, 2. Tap ACTIVE or AUTO-RENEWED, 3. Select CANCEL. This is the exclusive and approved process for canceling your membership, and we are unable to accept cancellation requests through any other means. No other communication (phone, email or verbal) is accepted.
When you become a member, the Registration Fee and the first month's Membership Fees will be charged to your credit card or debit card. However, it's important to note that the first month's Membership Fees are charged on a pro rata basis up until the 1st day of the following month. This means that the amount charged for the first month's Membership Fees will be based on the number of days from your start date up until the 1st day of the following month. The second charge for your Membership Fees will then take place on the 1st day of the following month.
Your second monthly Membership Fee will be charged on the first day of the month following your membership start date, except if you joined prior to the club's opening, in which case it will be charged monthly after the club has opened. Monthly payments will be debited from your bank account, and you can modify your bank details if necessary by contacting us via our contact form.
In case of medical reasons, your Direct Debit Membership can be paused for up to 90 days during the lifetime of the Membership. However, it is necessary to produce a letter from a medical professional to confirm the inability to use the facilities. Depending on the date of submission, any pre-paid fees will be credited upon your restart of membership. No refunds will be issued in such instances.
Please be advised that subsequent monthly Membership Fees are not refundable, and in the event of an unpaid payment, it will be backdated to the due date, which is linked to your membership start date. If a monthly Membership Fee is returned unpaid or any other payment method is not honoured, we will notify you by email for payment and your access will be suspended. You must make payment by credit card or debit card to reactivate your access and avoid the €30 Registration Fee. Failure to pay will result in the automatic cancellation of your account and you will be required to pay the Registration Fee again if you wish to re-join. Please note that all unpaid Fees may be subject to bank charges, which will be borne by you.
UPFRONT TERM MEMBERSHIP TERMS & CONDITIONS
This agreement shall become effective upon your indication of acceptance in the web/digital joining process.
Your membership shall commence immediately upon registration, unless you opt for a deferred Start Date. However, in case of pre-opening membership at a new club, your membership will commence on the day the club opens.
As a member, you shall be entitled to exercise all the rights and privileges pertaining to the selected membership type. It is important to note that this agreement is non-transferable and cannot be assigned to any other person at any point in time.
You are required to carry your club access QR code with you at all times to gain entry into the club.
Upon your membership registration, the full upfront amount of Membership Fees shall be collected from you. It is important to note that these fees are non-refundable under any circumstances.
If you have an Upfront Term Membership, this will be auto-renewed following the initial commitment term onto the same commitment term or the stated subsequent roll-over weekly/bi-weekly/monthly charge at sign up with automatic renewal and payment from the stored method of payment, unless cancelled with a 30-day notice period.
To process your cancellation for any membership type, kindly use the self-managed method via the FUSE App by following these steps: 1. In the home screen, tap ME, 2. Tap MEMBERSHIPS, 3. Tap ACTIVE/AUTO-RENEWED, 4. Select CANCEL. This is the exclusive and approved process for canceling your membership, and we are unable to accept cancellation requests through any other means. No other communication (phone, email or verbal) is accepted.
In case of medical reasons, your upfront Membership can be paused for up to 90 days during the lifetime of the Membership. However, it is necessary to produce a letter from a medical professional to confirm the inability to use the facilities.
In the event that you allow your Membership to lapse, you may be required to pay additional fees to re-join.
FIRST WEEK €1 MEMBERSHIP TERMS & CONDITIONS
Applicability of Standard Terms to Promotional Offers: The "First Week for €1" offer constitutes the first week of a standard 1-week Rolling Term membership. All provisions set forth in the WEEKLY MEMBERSHIP TERMS & CONDITIONS—including but not limited to the 7-day notice period, the exclusive App-based cancellation process, and the automatic Thursday billing cycle—apply in full to any member joining under this or any other promotional offer.
Prohibition of Duplicate Accounts and Penalty Charges: Members are strictly prohibited from creating multiple or duplicate accounts (using different email addresses, names, or payment methods) to access introductory rates or promotions. If a member is found to have created a duplicate account to exploit the "First Week for €1" offer, FUSE reserves the right to apply a manual pro-forma charge of €13.99 to the account. Subsequently, the second week of membership—which the member attempted to bypass—will be billed immediately at the full standard rate to ensure the account is brought up to date.
Abuse and Termination: Any attempt to circumvent the billing system through the repeated use of introductory offers is considered a material breach of the Membership Agreement. FUSE reserves the right to permanently ban individuals found to be abusing promotional offers from all current and future FUSE locations.
Promotional Integrity: All promotional offers are subject to a "one per person" lifetime limit unless otherwise stated. FUSE reserves the right to request valid government-issued photo identification to verify the identity of any member claiming an introductory promotion.
